1. Introduction
In accordance with the Digital Millennium Copyright Act (DMCA) and applicable copyright laws, Tickle has adopted this Copyright Dispute Policy to address claims of copyright infringement.
Tickle reserves the right to:
Block access to or remove material that we believe in good faith to be copyrighted material that has been illegally copied and distributed through our services.
Remove and permanently restrict access for repeat infringers.
Your use of Tickle’s services is subject to our Terms of Use, which incorporate this Copyright Dispute Policy.
2. Scope of Copyright Disputes & Save to Wallet Functionality
Tickle offers a variety of services, including:
The Tickle Mobile App and Tickle Browser Extension, which allow users to save advertisements and brand content.
The Save to Wallet feature, which enables users to save brand promotions directly into Apple Wallet or Google Wallet.
Tickle does not host user-generated content within Save to Wallet ads—these ads are controlled by advertisers and brands. Therefore, copyright claims related to Save to Wallet ads should be directed to the advertising brand unless the infringing content is hosted by Tickle.
Tickle will investigate copyright claims only when the allegedly infringing material is hosted directly by Tickle (e.g., on our website, app, or extension).
3. Procedure for Reporting Copyright Infringements
If you believe that material residing on or accessible through Tickle’s services infringes your copyright (or the copyright of someone you represent), please send a copyright infringement notice containing the following information to Tickle’s Designated Copyright Agent:
A physical or electronic signature of the copyright owner or an authorized representative.
Identification of the copyrighted work(s) claimed to be infringed, or, if multiple works are affected, a representative list of such works.
Identification of the material that is claimed to be infringing, with information sufficient to locate it within Tickle’s services.
Your contact details, including address, phone number, and email address.
A good faith statement confirming that the disputed use is not authorized by the copyright owner, its agent, or the law.
A statement under penalty of perjury that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.
4. Tickle’s Response to Copyright Complaints
Upon receiving a valid copyright infringement notice, Tickle will:
Remove or disable access to the allegedly infringing material.
Notify the content provider (if applicable) about the complaint.
If the content provider is a repeat offender, terminate their access to the service.
Tickle is not obligated to restore removed content unless a valid counter-notice is received (see Section 5).
5. Counter-Notice Procedure
If you believe that your content was wrongfully removed, you may submit a counter-notice to Tickle’s Designated Copyright Agent with the following information:
A physical or electronic signature of the content provider.
Identification of the removed material and its original location before removal.
A statement under penalty of perjury that the content was removed due to mistake or misidentification.
Your contact details, including name, address, phone number, and email.
A statement consenting to the jurisdiction of the Federal Court for the judicial district where you reside (or, if outside the US, consenting to jurisdiction in any judicial district where Tickle operates).
A statement agreeing to accept service of process from the party who filed the original copyright complaint.
Upon receiving a counter-notice, Tickle may restore the removed content after 10–14 business days, unless the original complaining party files a court action seeking an injunction.
6. Repeat Infringer Policy
Tickle enforces a zero-tolerance policy for repeat copyright offenders. If a user, advertiser, or content provider receives multiple copyright complaints, Tickle may:
Permanently terminate their access to the service.
Forfeit any stored data, offers, or rewards associated with their account.
Tickle reserves the right to take additional legal action against repeat infringers.
