1. Introduction

These Terms of Use (the "Agreement") are a contract between you and Tickle Global LTD (UK), Tickle Inc. (US), and Tickle Media US Inc. (where applicable) (collectively, "Tickle") and govern your access to and use of the Tickle mobile application ("Tickle Mobile App"), the Tickle browser extension ("Tickle Extension"), the Tickle Save to Wallet functionality, the Tickle website located at www.JoinTickle.com, and all other Tickle-branded websites and software applications (collectively, the "Service").

Tickle’s Service allows users to save advertisements and content that they see on other publisher mobile phone applications, mobile websites, and desktop websites for the purpose of saving them for later and to unlock offers, discounts, rewards, experiences, and other prizes. Members can also use the Service to earn Tickle Gold loyalty rewards points. The Service is available through multiple channels, including the Website, browser extension, and mobile app.

By accessing or using any part of the Service, you agree to comply with and be bound by this Agreement. This Agreement applies to all users, including "Members" (users who create an account with Tickle) and "Visitors" (users who interact with the Service without creating an account). The terms "you" or "User" refer to any Visitor or Member. The terms "we," "our," or "Tickle" refer to the company and its entities.

You must be an individual and at least 18 years old, or the age of majority in your country of residence, to use the Service. By using the Service, you represent and warrant that you have the legal capacity to enter into a binding contract. The Service is for personal, non-commercial use only. Unauthorized use of the Service for commercial purposes or on behalf of any third party is strictly prohibited.

2. Users Based Outside the UK

If you are based in Europe but outside the UK, you agree to the applicable supplemental terms that are included at the end of this Agreement, so please review them carefully.

If you are based in the United States, Canada, Australia, or New Zealand, or anywhere else outside of Europe or the UK, then the applicable Terms of Use that govern your use of the Service are set forth here: www.JoinTickle.com/terms-us.

The legal entity responsible for your use of the Service varies based on your location. Users outside the UK may be subject to local jurisdiction laws that impact their rights and obligations under this Agreement. Tickle reserves the right to modify these terms based on regional regulations or changes in law.

3. Accepting the Terms

By using any portion of the Service, you agree to comply with and be bound by this Agreement. This Agreement applies to you regardless of whether you are a "Member" (which means you have created an account with Tickle) or are a "Visitor" (which means that you are using the Service but have not created an account with Tickle). The terms "you" or "User" refer to a Visitor or a Member. The terms "we" or "our" refer to Tickle.

If you do not agree to all the terms of this Agreement, then you may not use the Service. By accessing or using the Service, you confirm that you have read, understood, and accepted all terms and conditions stated herein. If you are accepting these terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to this Agreement.

We may amend this Agreement from time to time, and we will notify you of any changes by updating the date at the top of this Agreement. It is your responsibility to review the Agreement periodically for any modifications. Your continued use of the Service after any changes to this Agreement constitutes your acceptance of the revised terms.

4. Amendments to this Agreement

Tickle reserves the right to update or modify this Agreement at any time, and we will notify users of any changes by updating the "Last Updated" date at the top of this Agreement. In some cases, we may provide additional notice, such as an email notification or an in-app message, regarding significant modifications.

Any modifications to this Agreement will become effective immediately upon posting, unless otherwise stated. Your continued use of the Service after any such modifications constitutes your acceptance of the new terms. If you do not agree with any changes to the Agreement, you must discontinue your use of the Service immediately.

It is your responsibility to review this Agreement periodically to ensure that you remain informed of any updates. Tickle will not be liable for any loss or damage arising from your failure to review the updated terms.

5. Privacy and Your Personal Information

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and disclose information about you when you use the Service. The Privacy Policy is incorporated into and forms a part of this Agreement.

By using the Service, you consent to the collection and use of your personal information as described in our Privacy Policy. This may include the collection of information such as your name, email address, device information, and interactions with advertisements and saved content. We do not sell your personal information to third parties but may share certain data with our partners as outlined in the Privacy Policy.

If you do not agree with our data collection and usage practices, you must discontinue use of the Service. You also have the right to request access to, correction of, or deletion of your personal information by contacting us at privacy@JoinTickle.com.

6. Description of the Service

The Service provides users with tools to save advertisements and promotional content they encounter on digital platforms, including websites, mobile applications, and other online services. Tickle enables users to save and revisit this content, unlocking exclusive offers, discounts, and loyalty rewards associated with the saved ads.

Tickle’s Service is accessible via the Tickle Mobile App, the Tickle Browser Extension, and the Tickle Website. The Service may also integrate with third-party platforms to enhance the user experience. Users may create an account to personalize their ad-saving experience, track their rewards, and manage their saved offers efficiently.

The Tickle Save to Wallet functionality allows users to store saved ads within their digital wallets (such as Apple Wallet and Google Wallet) for easier access and redemption at participating merchants. This feature is designed to provide seamless interaction between users and brands, enhancing the effectiveness of digital advertising and engagement.

Tickle does not guarantee the availability, accuracy, or continued validity of any offers, discounts, or promotions associated with saved ads. Users acknowledge that all promotional content is subject to expiration, modification, or withdrawal by the respective merchants or advertisers. Tickle is not responsible for any changes to offers made by third-party merchants.

Users agree to utilize the Service in compliance with all applicable laws and regulations. Any misuse, unauthorized access, or attempt to manipulate the Service for fraudulent purposes may result in the suspension or termination of the user’s account.

7. Merchant Websites and Purchases

Tickle provides users with the ability to save advertisements and promotional offers from third-party merchants for future reference. Tickle does not own, sell, resell, furnish, provide, manage, or control any of the products or services offered by merchants whose advertisements appear on the platform.

When users interact with a merchant’s advertisement through the Service or Save to Wallet feature, they acknowledge that any resulting transactions are solely between them and the third-party merchant. Tickle is not responsible for any issues related to pricing, availability, product descriptions, fulfillment, customer service, returns, or any other aspect of transactions conducted with third-party merchants.

Tickle may provide links or integrations that direct users to external merchant websites. These websites are not operated by Tickle, and we do not endorse, monitor, or assume responsibility for their content, privacy policies, or business practices. Users should review the terms of use and privacy policies of any merchant website they engage with through our Service.

Save to Wallet and Merchant Transactions

  • Offers saved using the Save to Wallet feature are subject to the merchant’s redemption terms.

  • Tickle does not guarantee the validity, availability, or continued applicability of saved offers.

  • Merchants reserve the right to modify or withdraw offers at their discretion, and Tickle is not liable for any changes or refusals to honor saved offers.

Users acknowledge that all promotional content is subject to expiration, modification, or withdrawal by the respective merchants or advertisers, and Tickle has no control over the redemption process once an offer is stored in a digital wallet.

8. Merchant Returns

If you are unhappy with a product purchased from a third-party merchant, need to return an item, or have not received your order, you must contact the merchant directly. Tickle does not process refunds, returns, or exchanges for purchases made through merchant advertisements saved via the Service.

Each merchant has its own return, refund, and exchange policies. Tickle is not responsible for enforcing merchant policies, nor does it guarantee the resolution of disputes between you and the merchant. Users should review the merchant’s return policy before making a purchase.

If you experience an issue with a purchase, we recommend reaching out to the merchant’s customer support team for assistance. Tickle does not assume liability for product quality, fulfillment, shipping, or customer service provided by third-party merchants.

9. Tickle Mobile App

The Tickle Mobile App is available for download on iOS and Android devices. The app enables users to save advertisements, track Tickle Gold Rewards, and access personalized promotions.

By downloading and installing the Tickle Mobile App, you grant Tickle permission to send notifications, collect usage data, and access certain device functionalities as outlined in our Privacy Policy. You may adjust your notification preferences within the app settings.

Your use of the Tickle Mobile App is subject to the terms and conditions set forth by your device’s operating system provider, including Apple’s App Store Terms and Google’s Play Store Policies. Tickle is not responsible for any issues related to app compatibility, software updates, or third-party integrations.

Users are prohibited from modifying, reverse-engineering, or attempting to interfere with the functionality of the Tickle Mobile App. Any unauthorized use may result in account suspension and legal action.

10. Account Information from Third-Party Sites

The Service may allow you to link your Tickle account with third-party sites and services, including social media platforms, merchant accounts, and payment providers. By linking your account, you authorize Tickle to access, store, and use certain information from those third-party services as permitted by their respective privacy policies and your privacy settings on those platforms.

Tickle does not control the policies, security measures, or data handling practices of third-party sites. It is your responsibility to review their terms and privacy policies before linking your account. We are not responsible for any actions or failures of third-party services, including account breaches, incorrect data syncing, or changes to their terms that may affect your use of the Service.

If you choose to unlink your third-party accounts, certain features of the Service may become unavailable or limited. Tickle is not responsible for any loss of functionality or data resulting from unlinking third-party accounts.

11. Tickle Gold Rewards Program

The Tickle Gold Rewards Program (“Program”) allows users to earn Tickle Gold points (“Points”) through eligible engagements, including saving advertisements, interacting with specific brand promotions, and making purchases with participating merchants.

Earning Points

Points can be earned through:

  • Saving advertisements via the Tickle Mobile App or Browser Extension.

  • Completing promotional activities from participating brands.

  • Making purchases through Tickle-affiliated merchants (subject to merchant terms and conditions).

Points have no monetary value and cannot be redeemed for cash. Tickle reserves the right to modify or discontinue the methods for earning Points at any time.

Redeeming Points

Points can be redeemed for exclusive offers, discounts, and rewards provided by participating brands and merchants. Available redemption options may vary and are subject to change without prior notice.

Expiration and Forfeiture of Points

Points may expire if not redeemed within a designated timeframe, as outlined in the Tickle Rewards Program Terms. Tickle reserves the right to adjust expiration policies at its discretion.

Program Modifications

Tickle may update or terminate the Program at any time without liability. If the Program is discontinued, any unredeemed Points may be forfeited.

Users agree to comply with all terms related to the accumulation and redemption of Points. Fraudulent activity or misuse of the Program may result in the suspension or termination of a user’s account. 

12. Maintenance of Tickle Gold Rewards Points

Tickle Gold Rewards Points are accumulated based on user activity and interactions with advertisements, brands, and promotional campaigns. Users must comply with all applicable program rules to maintain their earned Points.

Point Expiration and Deduction

  • Points may expire if they remain unused for a specified period, as outlined in the Tickle Rewards Program Terms.

  • If a user account remains inactive for an extended period, Tickle reserves the right to deduct or expire accumulated Points.

  • Any fraudulent activity, misuse, or violation of program terms may result in forfeiture of Points.

Account Activity and Point Adjustments

  • Tickle reserves the right to review, adjust, or correct any Points balance in case of errors, technical malfunctions, or unauthorized accumulation.

  • Users may request a review of their Points balance if discrepancies arise, but final decisions on Points adjustments are at Tickle’s sole discretion.

Program Changes and Termination

  • Tickle may modify or terminate the Rewards Program at any time. If the program is discontinued, users may lose any unredeemed Points.

  • Users will be notified in advance of significant program changes where possible, but Tickle is not liable for lost Points due to program termination.

Users acknowledge that participation in the Tickle Gold Rewards Program is voluntary and agree to comply with all program rules and updates. 

13. Referral Program

Tickle may, from time to time, offer a referral program that allows users to invite friends to join the Service in exchange for rewards. By participating in the referral program, you agree to comply with the terms outlined in this section.

Eligibility

  • Users must have an active Tickle account to participate in the referral program.

  • Referred friends must be new users who have not previously registered for a Tickle account.

  • Users may not create multiple accounts to refer themselves or engage in fraudulent referral activity.

Earning Referral Rewards

  • Rewards are granted only if the referred user signs up using the unique referral link and meets any required conditions (e.g., saving an advertisement or making a qualifying purchase).

  • The type and value of referral rewards are subject to change at Tickle’s discretion.

  • Referral rewards cannot be exchanged for cash and are non-transferable.

Misuse of Referral Program

  • Tickle reserves the right to withhold or cancel referral rewards in cases of suspected abuse, fraud, or violation of the program terms.

  • Users engaging in spam, self-referrals, or automated referrals will be disqualified from the program and may face account suspension.

Tickle may modify or terminate the referral program at any time. Users will be notified of significant changes where applicable. 

14. Electronic Notices

By using the Service, you consent to receiving communications from Tickle electronically, including but not limited to emails, push notifications, in-app messages, and other forms of digital communication. These electronic communications may include account-related updates, security alerts, promotional messages, and legally required disclosures.

Tickle may also provide notices by posting updates on its website or within the Tickle Mobile App. You agree that all such electronic notices satisfy any legal requirement that communications be in writing.

You are responsible for ensuring that the contact information associated with your account is accurate and up to date. If you wish to opt out of receiving promotional emails, you may do so by adjusting your preferences in your account settings or following the unsubscribe instructions included in the emails. However, you may still receive essential account and security-related notifications.

Save to Wallet Notifications

  • Users who utilize the Save to Wallet feature may receive notifications regarding the status, expiration, or redemption of saved offers.

  • These notifications are only sent via push notifications within the Tickle Mobile App.

  • Users can opt out of Save to Wallet notifications by disabling notifications on the specific ad card or deleting the ad card from their saved offers.

  • Tickle is not responsible for undelivered notifications due to device settings, outdated app versions, or technical issues with third-party wallet providers.

Tickle is not responsible for any failure to receive electronic communications due to outdated or incorrect contact information provided by the user.

15. Electronic Notifications

By using the Service, you consent to receiving electronic notifications related to account activity, security alerts, promotional offers, and updates about the Service. These notifications may be delivered via email, SMS, in-app messages, push notifications, or other digital means.

Types of Notifications

  • Account-Related Notifications: Includes password resets, security alerts, and updates on changes to account settings.

  • Promotional Notifications: Includes discounts, special offers, and rewards programs. You may opt out of these at any time.

  • Service Updates: Includes changes to the Terms of Use, Privacy Policy, or any essential modifications to Tickle’s features.

Managing Notifications

You can manage your notification preferences within your account settings in the Tickle Mobile App. Certain critical notifications, such as security alerts and changes to legal terms, cannot be opted out of.

Responsibility for Notifications

Tickle is not responsible for notifications that are undelivered due to spam filters, incorrect contact details, or mobile network restrictions. It is your responsibility to keep your contact information updated.

By continuing to use the Service, you acknowledge and accept receiving electronic notifications as described in this section.

16. Technology Disclaimer

The Service is provided on an "as-is" and "as-available" basis. Tickle makes no representations or warranties of any kind, whether express or implied, regarding the operation, performance, or availability of the Service, including but not limited to:

  • The accuracy, completeness, or reliability of the content provided.

  • The uninterrupted or error-free operation of the Service.

  • The absence of viruses, malware, or other harmful components in the Service.

  • The compatibility of the Service with all devices, browsers, or operating systems.

Tickle disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and security of data. Your use of the Service is at your sole risk.

Tickle is not responsible for any technical malfunctions, connectivity issues, service disruptions, or third-party software failures that may affect your ability to use the Service. We reserve the right to suspend, modify, or discontinue any aspect of the Service at any time without notice.

By using the Service, you acknowledge and accept these limitations and disclaimers. If you experience technical issues, we recommend contacting our support team for assistance at support@JoinTickle.com.

17. Rules for Posting Content

Tickle may allow users to post, submit, or share content, including but not limited to comments, reviews, feedback, and other materials (collectively, "User Content"). By submitting User Content through the Service, you agree to comply with the following rules:

Prohibited Content

  • User Content must not contain offensive, defamatory, abusive, or obscene material.

  • You may not post content that promotes discrimination, hate speech, harassment, or violence.

  • User Content must not include misleading, false, or deceptive information.

Intellectual Property Rights

  • You must have the legal right to post any content you submit.

  • You grant Tickle a non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable right to use, reproduce, distribute, and display your User Content in connection with the Service.

  • You agree that Tickle is not obligated to remove or modify any User Content unless required by law.

Moderation and Enforcement

  • Tickle reserves the right to monitor, remove, or edit any User Content that violates these Terms.

  • Users who repeatedly violate these posting rules may have their accounts suspended or terminated.

By submitting User Content, you represent and warrant that your content complies with these guidelines and that you have the necessary rights to grant Tickle the specified license to use your content.

18. Prohibited Activities

Users agree not to engage in any of the following prohibited activities while using the Service:

Unauthorized Use

  • Accessing or using the Service in a manner that violates any applicable laws or regulations.

  • Using automated scripts, bots, or any other unauthorized means to collect information or interact with the Service.

  • Attempting to probe, scan, or test the vulnerability of our systems or networks.

Misuse of Content and Services

  • Copying, modifying, distributing, selling, leasing, or sublicensing any part of the Service without authorization.

  • Attempting to reverse engineer, decompile, or extract source code from the Service.

  • Misrepresenting your identity, impersonating another individual, or providing false information.

Harmful Conduct

  • Posting or sharing any content that is defamatory, abusive, obscene, fraudulent, or misleading.

  • Engaging in harassment, threats, or hate speech against other users, Tickle employees, or third parties.

  • Introducing viruses, malware, or any harmful software to disrupt the Service or harm other users.

Fraudulent Activity and Misuse of Save to Wallet Feature

  • Exploiting the Service to obtain unauthorized benefits, including but not limited to fraudulently accumulating Tickle Gold Rewards.

  • Using multiple accounts to redeem duplicate wallet-stored rewards.

  • Attempting to modify, duplicate, or manipulate stored offers in a digital wallet.

  • Engaging in fraudulent behavior to exploit promotions or discounts offered through the Save to Wallet feature.

Tickle reserves the right to investigate and take appropriate action against any user engaging in prohibited activities, including suspension or termination of accounts, reporting violations to law enforcement, and pursuing legal remedies

19. Notification Disclaimer

Tickle makes reasonable efforts to ensure that users receive notifications regarding account updates, rewards, promotions, security alerts, and other relevant information. However, Tickle does not guarantee the timely delivery, accuracy, or reliability of notifications sent via push notifications or other communication channels.

Limitations of Notifications

  • Notifications related to Save to Wallet offers, rewards, and other service updates are not guaranteed.

  • Tickle is not responsible for undelivered notifications due to technical issues, spam filters, incorrect device settings, or user-configured app restrictions.

  • Users are responsible for ensuring that their device settings allow notifications from the Tickle Mobile App.

User Responsibility

  • It is your responsibility to ensure that the contact information associated with your account is accurate and up to date.

  • Users should regularly check their Tickle app and digital wallet for updates on saved offers and rewards.

  • If a notification is not received, users must manually verify the status of their saved offers.

By continuing to use the Service, you acknowledge that notification delivery is not guaranteed, and Tickle is not liable for any consequences arising from undelivered or delayed notifications.

20. Governing Law and Forum for Disputes

This Agreement and any disputes arising from or relating to the Service shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Dispute Resolution Process

  • If a dispute arises between you and Tickle, we encourage you to first contact our support team to seek an informal resolution.

  • If a resolution cannot be reached informally, any disputes shall be resolved through binding arbitration, unless you opt out within 30 days of agreeing to these Terms.

  • Arbitration shall be conducted under the rules of the London Court of International Arbitration (LCIA) or another mutually agreed arbitration provider.

  • The arbitration will be conducted in the English language, and the seat of arbitration shall be London, United Kingdom.

Class Action Waiver

  • You agree that any disputes will be conducted on an individual basis and not as part of a class action lawsuit.

  • By using the Service, you waive any right to participate in collective or representative claims.

Jurisdiction

  • If arbitration is not applicable or enforceable, any disputes shall be brought exclusively in the courts of England and Wales.

  • Users based outside of the UK acknowledge that they may be subject to additional jurisdictional laws and waive objections to venues in England and Wales.

Tickle reserves the right to seek injunctive relief or equitable remedies in any jurisdiction where necessary to prevent misuse of the Service or violations of intellectual property rights.

21. Miscellaneous

Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Any unenforceable provision will be replaced with a valid provision that most closely reflects the original intent.

No Waiver

Failure by Tickle to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer your rights or obligations under this Agreement without prior written consent from Tickle. Tickle may freely assign or transfer its rights and obligations under this Agreement without restriction.

Force Majeure

Tickle shall not be held liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, government actions, internet service disruptions, or cyber-attacks.

Survival

Any provisions of this Agreement that by their nature should survive termination (including, but not limited to, disclaimers, indemnity, and limitations of liability) shall continue in effect following termination of your access to the Service.

23. Right of Withdrawal

If you are a consumer residing in the European Economic Area (EEA), you may have the right to withdraw from certain transactions within 14 days of entering into a contract with Tickle, without providing a reason.

How to Exercise Your Right of Withdrawal

  • To withdraw from a contract, you must notify Tickle within the 14-day withdrawal period by submitting a clear written statement via email to support@JoinTickle.com.

  • You may use the withdrawal form available on our website, but it is not mandatory.

Effects of Withdrawal

  • If you exercise your right of withdrawal, we will refund any payments received from you for the applicable Service, excluding any non-refundable fees explicitly stated at the time of purchase.

  • Refunds will be processed within 14 days of receiving your withdrawal request and will be issued using the same payment method you used for the original transaction, unless otherwise agreed.

Exceptions to Withdrawal Rights

Your right of withdrawal does not apply in cases where:

  • The Service has already been fully performed within the withdrawal period with your prior consent.

  • Digital content has been accessed, downloaded, or otherwise used within the withdrawal period.

  • The transaction involves personalized or custom services that cannot be returned.

By using the Service, you acknowledge that you may lose your right of withdrawal in certain circumstances as permitted by applicable law. 

24. European Users Based Outside the UK

If you are a resident of a European Economic Area (EEA) country other than the UK, additional terms may apply to your use of the Service in accordance with applicable regional regulations.

Consumer Rights and Protections

  • EEA consumers may have additional rights under local consumer protection laws, including withdrawal rights, refund policies, and dispute resolution procedures.

  • Tickle will comply with all applicable EEA data protection laws, including the General Data Protection Regulation (GDPR). More details on data rights and processing are available in our Privacy Policy.

Jurisdiction and Governing Law

  • If you reside outside the UK but within the EEA, you agree that this Agreement shall be governed by the laws of your country of residence, where mandatory consumer protection laws require such application.

  • Disputes arising from your use of the Service may be resolved in local courts or through alternative dispute resolution mechanisms provided under EEA regulations.

Cross-Border Data Transfers

  • Your personal data may be transferred outside of the EEA to Tickle’s servers or third-party service providers located in other jurisdictions. Such transfers will be carried out in compliance with GDPR and other applicable regulations.

By using the Service, you acknowledge and agree that certain terms and policies may differ based on your country of residence, and you accept the application of regional consumer protection laws where applicable. 

25. Germany

If you are a resident of Germany, additional terms may apply to your use of the Service in compliance with German consumer protection and data privacy laws.

Consumer Rights and Protections

  • In accordance with German law, consumers have the right to withdraw from certain transactions within 14 days of agreeing to a contract with Tickle. Details of this right and withdrawal procedures are outlined in Section 23 (Right of Withdrawal).

  • Tickle complies with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). Users in Germany have additional rights regarding their personal data, including access, correction, deletion, and portability.

Jurisdiction and Governing Law

  • If you reside in Germany, this Agreement is governed by German law, unless mandatory European Union consumer protection laws dictate otherwise.

  • Disputes between users in Germany and Tickle may be resolved through local courts or alternative dispute resolution mechanisms recognized under German law.

By using the Service as a resident of Germany, you acknowledge and accept the applicability of German consumer protection laws and GDPR-related policies where applicable.

26. Italy

If you are a resident of Italy, additional terms may apply to your use of the Service in compliance with Italian consumer protection and data privacy laws.

Consumer Rights and Protections

  • Italian consumers have rights under the Italian Consumer Code (Codice del Consumo), including withdrawal rights, warranty protections, and fair contract terms.

  • In accordance with Italian law, users have the right to withdraw from certain transactions within 14 days, as detailed in Section 23 (Right of Withdrawal).

  • Tickle complies with the General Data Protection Regulation (GDPR) and applicable Italian data protection laws, including Legislative Decree 196/2003 (Italian Privacy Code).

Jurisdiction and Governing Law

  • If you reside in Italy, this Agreement is governed by Italian law, unless mandatory European Union consumer protection laws require otherwise.

  • Any disputes between users in Italy and Tickle may be resolved through local courts or alternative dispute resolution mechanisms recognized under Italian law.

27. California Users

If you are a resident of California, additional rights and protections apply under the California Consumer Privacy Act (CCPA) and other applicable state laws.

California Consumer Privacy Rights

  • You have the right to request access to the personal information that Tickle has collected about you.

  • You have the right to request that Tickle delete any personal information collected from you, subject to certain legal exceptions.

  • You have the right to opt out of the sale or sharing of your personal data.

How to Exercise Your Rights

  • You may submit a request to access or delete your personal information by contacting Tickle at privacy@JoinTickle.com.

  • Tickle will verify your identity before processing any privacy-related requests in compliance with California law.

Do Not Track Signals

  • Tickle does not currently respond to "Do Not Track" signals from web browsers, as there is no industry-wide standard for compliance.

Shine the Light Law

Under California’s "Shine the Light" law, residents may request information regarding how Tickle shares personal information with third parties for direct marketing purposes. To make such a request, please email privacy@JoinTickle.com with the subject line "Shine the Light Request."

By using the Service as a resident of California, you acknowledge that your rights are governed by state privacy laws, and you may exercise these rights in accordance with applicable regulations. 

28. Dispute Resolution

If a dispute arises between you and Tickle regarding the Service, we encourage you to first contact our support team at support@JoinTickle.com to seek an informal resolution. Most concerns can be quickly resolved in this manner.

Binding Arbitration

If an informal resolution cannot be reached, you agree that any dispute, claim, or controversy arising out of or relating to this Agreement or your use of the Service shall be resolved by binding arbitration, except where prohibited by law. The arbitration will be conducted in accordance with the rules of the London Court of International Arbitration (LCIA) or another mutually agreed arbitration provider.

  • The arbitration shall take place in London, United Kingdom, and will be conducted in the English language.

  • Each party shall bear its own costs for arbitration, except where applicable laws provide otherwise.

  • The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver

  • You agree that any disputes will be resolved on an individual basis and not as part of a class action or consolidated proceeding.

  • By using the Service, you waive your right to participate in a class action lawsuit or class-wide arbitration.

Exceptions to Arbitration

  • Either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent unauthorized use of the Service or violations of intellectual property rights.

  • If the arbitration agreement is deemed unenforceable, disputes shall be brought exclusively in the courts of England and Wales.

By using the Service, you acknowledge and agree to this dispute resolution process. If you do not agree, you must discontinue use of the Service immediately.

29. Termination and Suspension

Tickle reserves the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to:

Grounds for Termination or Suspension

  • Violation of these Terms of Use or any other policies associated with the Service.

  • Engagement in fraudulent, abusive, or illegal activities.

  • Misuse of the Tickle Gold Rewards Program, Referral Program, or any other promotional features.

  • Providing false information or engaging in deceptive practices while using the Service.

  • Unauthorized use of the Service or infringement of intellectual property rights.

Effects of Termination

  • Upon termination, your right to access and use the Service will cease immediately.

  • Any unredeemed rewards or benefits may be forfeited, and Tickle shall not be liable for compensation.

  • If your account is terminated due to a violation of these Terms, you may be prohibited from creating a new account in the future.

User-Initiated Account Closure

  • You may close your Tickle account at any time by contacting support@JoinTickle.com.

  • Closing your account may result in the permanent loss of all accumulated rewards, saved content, and account data.

30. Additional Disclosures

Tickle may provide additional disclosures specific to users in different jurisdictions. These disclosures do not override the general terms outlined in this Agreement but serve to clarify user rights and obligations based on applicable laws.

Legal Compliance

  • Tickle complies with all relevant consumer protection, data privacy, and electronic communication laws applicable in jurisdictions where it operates.

  • If any part of this Agreement is found to be unenforceable, the remaining provisions shall remain in effect.

User Responsibility

  • Users are responsible for understanding how their jurisdiction’s laws apply to their use of the Service.

  • By continuing to use the Service, you acknowledge that additional disclosures may be updated or amended over time.

31. Save to Wallet Functionality & Legal Protections

31. Save to Wallet Functionality & Legal Protections

Tickle’s Save to Wallet feature allows users to store advertisements, promotional offers, and rewards within digital wallets such as Apple Wallet and Google Wallet. By using this feature, you acknowledge and agree to the following terms:

Use of the Save to Wallet Feature

  • Users may save promotional content and offers to their digital wallets for later use.

  • Saved offers are subject to expiration dates and may be modified or removed by the merchant at any time.

  • Tickle is not responsible for any discrepancies between the stored offer and the merchant’s terms upon redemption.

Liability Disclaimer

  • Tickle is not liable for any financial loss, misuse, or failure of the Save to Wallet feature due to third-party technical issues.

  • Merchants are solely responsible for the fulfillment of saved offers and promotions.

  • Users agree that Tickle does not guarantee the continued availability of any offers stored in their digital wallets.

Data Protection

  • Information stored via the Save to Wallet feature is subject to Tickle’s Privacy Policy.

  • Users acknowledge that third-party wallet providers (e.g., Apple, Google) have their own terms and privacy policies governing data storage and usage.

By using the Save to Wallet feature, you acknowledge and accept the above terms and agree to hold Tickle harmless from any disputes arising from offer redemption or technical failures.

This document supersedes all previous versions of the Terms of Use. Continued use of Tickle’s services constitutes agreement to these terms.
